L'Oréal wins trademark battle with Azalee Cosmetics
French multinational L'Oréal has persuaded an EU court to refuse French cosmetics brand Azalee Cosmetics' attempt to register its "La Crème Libre" trademark, ruling that French-speaking consumers may confuse or associate the sign with an earlier-made, similar L'Oréal trademark.
The General Court ruled that Azalee Cosmetics could not register its sign because the word 'libre" (which means 'free' in French) serves as the sign's only distinctive element and also appears on L'Oréal (UK) Ltd.'s earlier sign.
Azalee had previously applied to register its La Crème Libre logo in 2020 for a range of areas including body and facial treatments, cosmetic tools and retail services.
